Florida Senate set to vote on 'stand your ground' bill next week

If the full senate approves the new legislation, it would increase the amount of protection gunowners have when they claim self-defense.

Currently, the burden of proof is on the person claiming self-defense to prove they were in fact threatened or in imminent danger.

If the new law passes, the burden shifts to prosecutors who would have to prove self-defense wasn't warranted.

The debate over the stand your ground proposal is polarizing with gun advocates saying the law makes sense, while those against guns say it will just lead to more "trigger happy shooters" that would be more protected from prosecution.
in other news the shooting death rate goes up

Innocent until proven guilty, that's alll this does and that's the way it should be. That's the job of a prosecutor to prove beyond a reasonable doubt the persons guilt in any crime. To say it will increase the death rate is just dumb. Your still gonna have to go through all the legal b.s. Same as before.

    Yes.

Why should someone have to spend all their money and time defending themselves in court if the state can't even prove that the shooting was not justified?

As a Florida resident, I am for the change. There are more fools here than you can shake a stick at, and they seem to have a death wish.
Anyone that shoots in self-defense, would love to have me on the jury.

its a fact that when gun laws are passed like this the death rate does go up. simply put if your hands are not tied to how you defend your self people are going to chose the most lethal and easiest way possible.

as far as going through the legal system a great deal of SD shooters are arrested anyway, but not spared the meat grinder as some overzealous prosecutor looking to make a name for himself. look at the Fla woman that shot a warning shot at her ex husband in her own home as he was assaulting her. she got arrested defending her own home from him

That's the exact same argument people, and other nations, make for gun control.

It's false too (if statistics matter).

Murder rates (per 100,000 people) have gone down considerably in this nation since 1996. That's true nationally, as well as being true for the "Stand Your Ground" and "Castle Doctrine" states. Murder rates have gone down even though more people are carrying guns legally and have more legal self defense related protections from prosecution than at any time in the last century.

    really? lets take a look

"These laws lower the cost of using lethal force," says Mark Hoekstra, an economist with Texas A&M University who examined stand your ground laws. "Our study finds that, as a result, you get more of it.
"Now, researchers who've studied the effect of the laws have found that states with a stand your ground law have more homicides than states without such laws.
no one says they aren't justified..... just does up beause non violent citizens have the right to SD

"Our study finds that, that homicides go up by 7 to 9 percent in states that pass the laws, relative to states that didn't pass the laws over the same time period," he says.

Yet the murder rates have actually gone down.

    http://www.deathpenaltyinfo.org/murd...ally-and-state

And many of the"Stand Your Ground" states boast far lower murder rates than the anti-gun states.

It doesn't matter anyway. Right is right, whether it makes us safer, or not.

If safety was the ultimate authority, ban guns. Murder rates are lower in many of the nations where people like barstoolguru are not allowed to own guns.

Best thing to do after saving your own life if you have too is just leave and let the city come and clean up the pile of shit off the ground.
